We will be taking a handyman to court soon He did several small jobs for us Poor work, did zero clean up (we had to clean up after him - including when he sanded inside with no vacuum attachment), he would use our household items without asking, and it would take over a month for a small project to be completed He also lied about a damage he caused, fought a loaded gun onto our property numerous times after being told to keep his gun off our property, and brought a “friend” to help who used drugs in our home We have small children We paid him for everything and have receipts But he doubled up a job on two invoices and was paid twice for the same $500 job, and took our $900 deposit on a job and refuses to do the job or refund us our money His reasoning is because he wants more money for the work he did, that we paid in full So, basically he stole $1,400 from us We are nervous because we have never been to court before Wish us luck!

Things like how you dress, how much you sell your case etc should ideally, have no bearing on your judgement whatsoever - you know, because truth doesnt change based on how you look or speak etc so while I agree with the need to have a professional appearance, I am repulsed by the fact that these things affect an outcome what a disgusting society we live in

I think your advices are universal Independent from which state, or country you are, whether it’s a small claim court or more serious It’s all make sense But it’s good to hear and keeping in mind Also practicing, especially if someone suffers from mental health issues Emotions can be overwhelming, it’s hard to put a lid on sometimes

A coworker backed into my car and we decided to setting with out insurance I didn't do a police report She only paid a fraction of the damages over a period of 9 months and stiffed me on the rest My most important evidence is text message conversation between me and the defendant that she would pay Is a text message conversation enough evidence to win in small claims court or should I not even bother? I would like to ask the attorney a question I am suing for private nuisance involving 2 different nuisances The first is dog waste accumulations behind my shared fence, which my adjacent neighbor refuses to remove for what looks like and smells like 3 mths at a time The stench especially in the hot summer has caused me a loss of use and enjoyment of my backyard Being disabled this constant nuisance prevents me from using my pool for therapeutic purposes and my patio for outdoor enjoyment I contacted the dept of environmental health a few time and the hoa several times but still the neighbor continues to maintain this nuisance as it is continuously repeated I have been told to seek resolution in civil court(by the hoa and the health dept) because they can only send a letter which doesnt charge the defendants behavior How is the best way to determine the value per day which I can apply towards my loss of use and enjoyment? Do I take a certain percentage of the rental value of my house? The hoa has not taken an active role to enforce compliance and I dont want the judge to think that because I live in an hoa community, they are "handling the situation" I have a narrow yard and narrow pathways around my pool and these branches present an obstacle for me and since i am physically disabled they are a hazard and danger also I also want to stress am low income and have to pay 100s a yr to hire a gardner to cut off their branches since the tree owner refuse to cut off the branches most of the time My fear is what do I do if I get the same judge I had once before who wont allow me to present my evidence and just assumes the HOA will and has enforced the regulations when in fact they havent I have many photos and receipts and documents to present for both nuisances ,the dog waste and the encroaching tree limbs' as well as having doctors letters to testify to the stress and anxiety which has resulted from the nuisances and harassment from the neighbor Is this all too much for one small claims case? Should I separate it into two different hearings? PLEASE ADVICE Thank you, Debbie
