I will say this the AILA needs to warn USCIS that Officers need to use discretionary authority to APPROVE cases The immigrant community is a tight knit groupbrIf word gets out that USCIS is frivolously denying cases no one will want to apply, ego USCIS will go permanently bankrupt

I sent a letter during my wifes i130 application at the nvc and they said the 8 months wait (at that time) will start from the date the last letter was received Lol

We got a RFE that both asked for information we had already sent in our application and also for information that didn’t apply to our case So we did write a letter explaining just that brIt’s almost as if they sent the RFE with out going through our app! We flat out don’t have money for a lawyer We’re struggling just to get grocery’s because I can’t work right now due to me waiting for my work permit so, I guess I just hope we get some luck in what has been unlucky past couple of years :/

Is it normal for the petitioner on an I130 application to get sent to biometrics code 3? Why would they send a petitioner to biometrics and not the benefitary ?
