"No state shallmake anything but gold and silver coin a tender in payment of debt" US Constitution Article 1 Section 10 I did a lot of study on this subject and represented myself in an administrative law court in regards to my taxes owed almost 20 years ago As I remember, in the early 1970s a man demanded payment of his state income tax refund be provided in gold and silver coin It was Wisconsin I think The state supreme court decided that 'gold and silver coin' was a 'tender of the time' and we now used Federal Reserve Notes Now, my specific case was about the paper 'check' the government issued I sent in a negotiable instrument to pay my taxes Law says a negotiable instrument must meet the following: Must be dated Must state who is paying Must state who is to be paid Must state an exact amount Must be signed Must NOT have an expiration date Must NOT be drawn on funds set aside specifically to pay the instrument My argument was the state made the use of a written negotiable instrument legal when they sent out paper 'checks' That, in fact, my document that I had handwritten had more legality under law than their document Their document says that after a period of time it is void This violates the law that it cannot have an expiration date The state tried to argue that their check was drawn on a bank I pointed out that the document was drawn on the State Treasury, not a bank and that under the State Constitution the state was prohibited from running a bank Did I win? Hard to say I paid my taxes with cash there at the table and received a receipt I did not have to pay any late fee nor interest I was able to get the judge to sign the copy of my document that the state had brought saying that the original of this document was no longer allowed for collection and was voided (the state had not brought the original) At first, the judge didn't want to do this, but relented when I explained that since it met the legal definition of a negotiable instrument and that if this was not done, the document could be presented to me in the future with a demand of payment Comment from : ogr8bearded1 |
